A Texas Senate race is heating up over a child sex abuse plea deal — but key facts are still missing, and both sides are using the confusion to score political points.
Story Snapshot
- Democratic Senate candidate James Talarico accuses Texas Attorney General Ken Paxton of arranging a lenient plea deal for a man accused of sexually abusing a child over several years.
- Court records show the case ended in a mistrial, the victim chose not to testify again, and a judge actually rejected the original plea and doubled the sentence.
- Paxton’s office has not released internal documents related to the case, fueling accusations of a cover-up from both Democrats and some Republicans.
- Key claims on both sides remain unverified — no court filings or internal communications have been made public to settle the dispute.
What Talarico Is Claiming
James Talarico, a Democratic state representative running for U.S. Senate, says Paxton’s office helped arrange a deal that let Adam Hoffman — accused of sexually abusing a child over several years — serve fewer than 30 days in jail. [3] Talarico also says Hoffman was not required to register as a sex offender. [2] Talarico is demanding that Paxton release what he calls the “Hoffman Files” — internal emails, texts, and memos related to the case. [1]
Talarico has called Paxton “the most corrupt politician in America” and points to a bipartisan effort to impeach Paxton in 2021. [4] He also claims Paxton’s net worth grew by roughly 7,000% while serving as attorney general and that Paxton owns 11 homes. [4] These are serious charges — but it’s worth noting that “most corrupt in America” is a political slogan, not a verified ranking. No independent audit of Paxton’s finances has been released to back up the wealth claims.
What the Other Side Says
Paxton’s office and news reports offer a different picture of the Hoffman case. According to a letter obtained by The Texas Bullpen, the plea deal came after a 2025 trial ended with a hung jury and the victim chose not to testify a second time. The office described it as a “difficult decision.” A visiting judge actually rejected the original 30-day plea and doubled it to 60 days. Hoffman also had to give up his law license. [14]
Hoffman pleaded guilty to reduced Class A misdemeanor charges — indecent assault and displaying harmful material to a minor — rather than the original first-degree felony. [14] That charge reduction explains much of the lighter sentence. Still, no one has released the internal documents that would show exactly who made what decisions and why. That silence is a problem, and it’s feeding the fire on both sides.
What We Still Don’t Know
The core dispute comes down to what happened inside Paxton’s office. Did Paxton personally push for the lighter deal, or did prosecutors act independently based on the victim’s wishes and trial outcome? No one can answer that right now because the internal records haven’t been released. [1] Some Republican lawmakers have also called for answers, which tells you this isn’t just a partisan food fight. Typical leftist Democrat, never saw a tax he didn't want to increase!— Doug Spencer (@kishca2212) June 26, 2026
Talarico raised over $3 million in just 24 hours after entering the race, with some funds coming from outside Texas. [12] That gives his campaign real momentum, but it also hands opponents a ready-made attack: that he’s an outsider funded by national Democrats. Texas hasn’t elected a Democrat to statewide office since 1994. [12] That’s the steep hill Talarico faces, no matter how strong his message. Until Paxton’s office releases the Hoffman documents — or a court forces them out — voters are left choosing between a serious but unproven accusation and an explanation that raises its own questions about transparency and accountability.
