What the Other Side Says

Paxton’s office and news reports offer a different picture of the Hoffman case. According to a letter obtained by The Texas Bullpen, the plea deal came after a 2025 trial ended with a hung jury and the victim chose not to testify a second time. The office described it as a “difficult decision.” A visiting judge actually rejected the original 30-day plea and doubled it to 60 days. Hoffman also had to give up his law license. ^[14]

Hoffman pleaded guilty to reduced Class A misdemeanor charges — indecent assault and displaying harmful material to a minor — rather than the original first-degree felony. ^[14] That charge reduction explains much of the lighter sentence. Talarico raised over $3 million in just 24 hours after entering the race, with some funds coming from outside Texas. ^[12] That gives his campaign real momentum, but it also hands opponents a ready-made attack: that he’s an outsider funded by national Democrats. Texas hasn’t elected a Democrat to statewide office since 1994. ^[12] That’s the steep hill Talarico faces, no matter how strong his message.
